Hi Everyone~
I mentioned this case and provided the link in another post under "URGENT NEED HELP".
I felt it important to give it "its" own post so it wouldn't be overlooked.
Please look at this case.

Best~

Thanks for the link. I looked it over. Amazing.
Thank you for posting this. It was a very educational read.

Okay, I'm taking a stab at what MommaBear is seeing on page 13, paragraph 4.
MommaBear, are you seeing that the school district might be opposing a "ban" as one of the accommodations requested. That the "disagreement over the need for a particular accommodation." ? Specifically, the last line of that paragraph indicates that the parents requested a "ban" per se:
"...the best way to keep her safe is to prevent any possibility of exposure."
???????
Gail, I thought it was the following paragraph:
Under the district's approach, reasonableness includes such considerations as undue cost and infringement on the rights of other students
(Bold added by me.) (Also explains the *moral* connection - which I knew would be in there somewhere )
MB, am I still doing the bunny hop?
k, do you know if this was appealled?
Is this hearing judge saying that the people of Oregeon have "right" to bring food into the classroom anytime. Can I bring anything into the classroom as long as it is "appropriate" to my "culture, beliefs, languages or finances" regardless of whether or not it infringes on another student's safety?
This was from 2001, has anything happened since to clarify the obscurity of this hearing judge's ruling?
Actually the title for this thread is completely wrong. Is should read Schools and Parents Both Lose.

AnnaMarie, I think you're right. (I had the wrong paragraph.) Makes sense.
MommaBear, are you going to bump up the "Guns/Drugs" thread?
Edited to add that I call my spot right behind AnnaMarie in the bunny hop line.

I read the dates differently~ The hearing occurred on September 26 and 27, 2002. And post-hearing briefs were added as late as October 29, 2002.
River~
I don't know if they have appealed. This is one reason I am trying to see if they are on this site and could fill me in on what happened next. I suppose, if last resort, I could try and contact the docs or attorney to see if they could forward a message to the family.
I hate to do that unless absolutely necessary. Just seems sorta intrusive.
If they went through what we are going through now....I imagine they are still exhausted. Maybe they got real lucky and won a zillion dollars in the lottery and got
to buy their own private island and hire a professional teacher, cook, and massage person, have room in their little school they built ~ for others to come and learn along with their own children and eat wonderful good but peanut free food and live happily ever after....! Well then.
Hopefully we can find something out.
RP's parents are you out there?
Take Care Everyone~

What the hell was that?
I know better than to ask.
river, you are out of line. What are you so angry about anyway?
I certainly didn't intend to offend, nor for you to take any. I have no idea how you could read that into my post. Obviously, I was just clarifying that I read the dates differently (and wondered if perhaps I had read it incorrectly)... but hey, if that's offensive to you, well, then so be it.
Geesh!
